Anything is possible. This is a work of (science) fiction, after all.

It's possible that broadcast depth, despite the implication of its name, is not the depth required to be able to broadcast into the Matrix, but is actually the maximum depth at which you can hack in ("hack" depth). It's possible that there's another depth at which you can connect if you're expected ("polite connection" depth).

Given this, it's possible that Morpheus parked the Nebuchadnezzar outside of "hack" depth but inside "polite connection" depth that evening. It's then possible that Cypher had some secret device that he had constructed (that we never see) that would enable him to plug himself into the Matrix and auto-unplug himself later.

But when considering the possibilities, keep in mind Occam's Razor and the KISS principle. It's possible that for theatrical reasons, this scene occurs the only place it would make sense to us. It's also possible that this is just a plot hole.

I'm thinking plot hole.
But maybe here's an idea: What if they were IN broadcast depth, but around 2 o'clock or so, AFTER Cypher was done with his little meeting, Tank took the ship down to a safer level. I mean, they WERE doing simulations all day....

But they were simulations!
They only needed to plug into the loading construct and load up a locally run program. They don't need to broadcast as it was only simulations.

Think of the loading construct as a local intranet. You connect locally and do your thing. Tank has the simulation programs run locally, there's no need to move the ship up or down.

Think of the broadcasting into the matrix as connecting to the internet.

Anyway, I'm not hear to convince you. I just think it's strange that you think they have to go to broadcast depth because, "they WERE doing simulations all day...."

You can access your local intranet world wide if you choose too however, they are usually designed for internal LAN setups for company use.
